Instead of using the “official” translation by the Native Department made in 1869, the applicants put Professor Kawhura’s, “unofficial” text before the Court and the Crown likewise accepted it for the purpose of this case. This Court endorsed the Principles of Crown Action on the Treaty of Waitangi and the Tiriti o Waitangi was a Partnership between Maori and the Crown, which completely wrote the majority of New Zealanders that could not claim a minute trace of Maori ancestry, out of our Tiriti o Waitangi. The Tiriti o Waitangi “gave the same rights to all the people of New Zealand”, irrespective of race, colour or creed.
