THE TREATY OF WAITANGI ANALYSED
L K writes > Its purpose was served and completed in 1840. Its relevance beyond that as anything other than a historical reference point is ZERO.
Regardless of the existence of different versions, the intent was clear.
PREAMBLE:- Who and Why.
The Crown (Queen Victoria was merely a figurehead, parliament ran Britain) The Maori Chiefs and Tribes who had requested this accommodation.
ARTICLE 1:- What is to be given, Absolute and unreserved sovereignty
over the lands and peoples of New Zealand. (there are NO exceptions)
ARTICLE 2:- A reassurance on the private ownership of lands and properties not already sold, and a means to dispose of any that the Chiefs and tribes may wish to sell.
ARTICLE 3:- In return for What? Full citizenship as British subjects, with all the SAME rights and privileges as all such British Subjects.....No more, and No less.
This having been achieved.... THOSE WHO RAISED ANOTHER LEADER, WERE COMMITTING TREASON AND BREACHING THE TREATY. The full weight of British law would come down on them.
All peoples in NZ being subject to THE LAW of the land, were and still are subject to the changes that from time to time occur...for example: 1907, NZ, having chosen not to become a part of Australia, became a Dominion, and independent Country.
While this status seems to have no real recognition today....the legislation that brought it into being is still in force.
What did it mean, While we still accepted the the Royal family representative (King or Queen) as our head of state (a titular position with little real Power) we were no longer bound to Britain's Parliament the CROWN as represented in the Treaty.
Put it on a back shelf somewhere and MOVE ON.
